Terms of Service

These Terms of Service ("Terms") govern your access to and use of the website at advanced-financial.online and the AFT AI trading assistant, including any related software, dashboards, alerts and content (together, the "Service"), provided by Advanced Financial Technologies LLC ("Advanced Financial Technologies", "we", "us" or "our").

1. Acceptance of terms

By creating an account, connecting an exchange account or otherwise using the Service, you agree to be bound by these Terms, our Privacy Policy and our Risk Disclosure. If you do not agree, do not use the Service.

3. Eligibility

You must be at least 18 years old and able to form a legally binding contract to use the Service. You may not use the Service where doing so would be prohibited by applicable law, or if you are subject to sanctions administered by the U.S. Department of the Treasury's Office of Foreign Assets Control (OFAC) or another relevant authority. You are responsible for making sure your use of the Service and of any exchange complies with the laws where you live.

4. The service

AFT AI is a software tool that connects to your third-party cryptocurrency exchange account through an application programming interface ("API") key that you provide. It analyzes market data and your account data and gives you AI-generated market analysis, trade ideas, risk calculations, alerts and educational content ("Guidance").

• Non-custodial. We do not hold, custody, control or transmit your funds or digital assets. Your assets stay in your exchange account at all times.
• No automatic trading. The Service does not place trades on your behalf. You decide whether to act on any Guidance and you place any trade yourself.
• Changes to the Service. We may add, change or remove features at any time. We will try to give reasonable notice of material changes that negatively affect paid features.

5. No investment advice

We are not a broker-dealer, investment adviser, commodity trading advisor or fiduciary, and no such relationship is created by your use of the Service. Guidance is generated by automated models, may be inaccurate or incomplete, and does not take into account your full financial situation, objectives or needs. You are solely responsible for evaluating any Guidance and for all of your trading and investment decisions, and you should consider seeking advice from a licensed professional. Past performance, including any back-tested or illustrative results, does not guarantee future results.

6. Your account

You agree to provide accurate information when creating your account and to keep it up to date. You are responsible for keeping your login credentials secure, for enabling two-factor authentication where available and for all activity under your account. Notify us immediately at support@advanced-financial.online if you suspect unauthorized access.

7. Exchange connections and API keys

• You authorize us to access your exchange account through the API key you provide, only as needed to provide the Service.
• You must create API keys with read-only permissions and must never enable withdrawal permissions. We may refuse or disconnect keys with excessive permissions.
• You remain bound by your exchange's own terms. We are not responsible for the availability, security, accuracy of data, fees or actions of any exchange.
• You may revoke our access at any time by deleting the API key on your exchange or by disconnecting it in the Service.

8. Subscriptions and billing

• Plans. Some features require a paid subscription. Current plans and prices are shown on our Pricing page.
• Automatic renewal. Paid subscriptions renew automatically at the end of each monthly or yearly billing period until cancelled. You authorize us and our payment processor to charge your payment method for each renewal.
• Cancellation. You may cancel at any time in your account settings or by contacting us. Cancellation takes effect at the end of the current billing period, and you will keep access until then.
• Refunds. Except where required by law, payments are non-refundable and we do not provide refunds or credits for partial billing periods.
• Price changes. We may change prices with at least 30 days' notice. Changes take effect at your next renewal.
• Taxes. Prices do not include applicable taxes unless stated otherwise.

9. Acceptable use

You agree not to:

• use the Service for any unlawful purpose, including market manipulation, fraud or money laundering;
• resell, redistribute, publish or commercially exploit Guidance, or provide it to third parties as a signal service, without our written permission;
• reverse engineer, scrape, copy or attempt to extract our models, data or source code;
• interfere with, disrupt or attempt to gain unauthorized access to the Service or other users' accounts;
• share your account with others or create accounts using false information.

10. Intellectual property

The Service, including its software, models, design, text, graphics and trademarks, is owned by Advanced Financial Technologies or its licensors and is protected by intellectual property laws. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own personal trading purposes.

11. Third-party services

The Service relies on third-party services, including cryptocurrency exchanges, market data providers, hosting providers and payment processors. We do not control and are not responsible for third-party services, and your use of them is governed by their own terms.

12. Disclaimers

THE SERVICE AND ALL GUIDANCE ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, THAT DATA OR GUIDANCE WILL BE ACCURATE OR TIMELY, OR THAT USE OF THE SERVICE WILL RESULT IN ANY PROFIT OR AVOID ANY LOSS.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ADVANCED FINANCIAL TECHNOLOGIES AND ITS MEMBERS, MANAGERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY TRADING LOSSES, LOST PROFITS, LOST DATA OR LOSS OF DIGITAL ASSETS, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE OR ANY GUIDANCE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE OR (B) ONE HUNDRED U.S. DOLLARS (US$100).

14. Indemnification

You agree to indemnify and hold harmless Advanced Financial Technologies and its members, managers, employees and agents from any claims, losses, liabilities and expenses (including reasonable attorneys' fees) arising from your use of the Service, your trading activity, your violation of these Terms or your violation of any law or third-party right.

15. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you violate these Terms, if required by law or to protect the Service or other users. Sections that by their nature should survive termination (including Sections 5 and 10 to 16) will survive.

16. Governing law and disputes

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Duval County, Florida, and you consent to the personal jurisdiction of those courts. Before filing a claim, you agree to first contact us and try to resolve the dispute informally for at least 30 days.

17. Changes to these terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Service before they take effect. Continuing to use the Service after the changes take effect means you accept the updated Terms.
